These Terms of Service govern your use of oceandevotion.studio and purchases made from Ocean Devotion by Icebird Studio. By accessing this website or placing an order, you agree to these terms.
About Ocean Devotion
Ocean Devotion offers the Ocean Devotion Mail Club, original artwork, photography, fine art prints, framed prints, calendars, cards, digital products, and other art- and nature-inspired goods.
Some physical products are created and shipped directly by Ocean Devotion. Others are printed to order and fulfilled by third-party production partners, including Gelato.
Website Use
You may use this website for lawful, personal, and non-commercial purposes. You may not:
Copy, reproduce, download, distribute, sell, modify, or commercially exploit artwork, photographs, illustrations, writing, or other website content without written permission
Use website content to train artificial-intelligence systems or create derivative products
Interfere with the website’s operation or security
Use the website for fraudulent, unlawful, or abusive activity
Attempt to gain unauthorized access to the website or its systems
Intellectual Property
Unless otherwise stated, all artwork, photographs, illustrations, designs, writing, branding, and other original content displayed on this website are owned by Marlo Garnsworthy and protected by applicable copyright and intellectual-property laws.
Purchasing a physical or digital product does not transfer copyright or grant permission to reproduce, distribute, resell, alter, or commercially use the artwork.
Digital products are licensed for the personal use described in the applicable product listing. They may not be shared, resold, redistributed, uploaded to other websites, or incorporated into products for sale unless the listing expressly grants those rights.
Product Information
I make every reasonable effort to present product descriptions, dimensions, colors, materials, and images accurately. However:
Colors may appear differently on different screens
Printed colors may vary slightly from their on-screen appearance
Handmade and original artwork may contain natural variations
Product dimensions may vary slightly because of manufacturing processes
Mockups are illustrative and may not represent exact scale in every setting
Small variations that do not materially affect the product’s quality or appearance are not considered defects.
Availability
Products and variants may become unavailable without notice. Adding an item to a shopping cart does not reserve it.
I may limit quantities, discontinue products, correct listing errors, or cancel an order if a product is unavailable or was listed with materially incorrect information or pricing. If an order is cancelled after payment, the applicable amount will be refunded.
Prices, Taxes, and Shipping
Prices are displayed in the currency shown on the website and may change without notice.
Applicable taxes and shipping charges are calculated during checkout unless otherwise stated. Customers are responsible for any customs duties, import taxes, brokerage charges, or similar fees imposed by the destination country.
Payment
Payments are processed securely by the payment options presented during checkout. Ocean Devotion does not directly receive or store complete payment-card information.
An order is not accepted until payment has been authorized and an order confirmation has been issued. I reserve the right to cancel or decline an order where fraud, unauthorized payment, a pricing error, product unavailability, or another material problem is suspected.
Ocean Devotion Mail Club monthly memberships renew automatically and are charged each month until cancelled. You can manage or cancel your membership through your customer account. Cancellation stops future charges but does not refund a payment already processed or cancel a mailing already being prepared.
Mail Club Gift Memberships are paid in full at checkout for the selected number of months. They end after the final included mailing and do not renew automatically.
Made-to-Order Products
Many Ocean Devotion products are printed specifically for each order. Production may begin soon after an order is placed.
Customers are responsible for reviewing product selections carefully, including artwork, size, frame color, format, and shipping address. Once production has begun, made-to-order purchases generally cannot be changed or cancelled.
Shipping and Delivery
Estimated production and delivery times are estimates rather than guarantees. Delivery may be affected by carrier delays, weather, customs processing, high-volume periods, production interruptions, or other circumstances outside Ocean Devotion’s reasonable control.
Products within the same order may be produced in different locations and arrive in separate packages.
Customers are responsible for providing a complete and accurate shipping address and for monitoring tracking information. Risk of loss passes as permitted by applicable law.
Returns, Replacements, and Refunds
Purchases are governed by the separate Returns, Replacements & Refunds Policy displayed on this website and during checkout. That policy is incorporated into these Terms of Service.
Made-to-order products are not ordinarily returnable for changes of mind or incorrect customer selections. Damaged, defective, incorrectly printed, or incorrect items will be handled in accordance with the Returns, Replacements & Refunds Policy.
Nothing in these terms limits rights that cannot legally be excluded.
Digital Products
Digital purchases are delivered electronically and are generally non-refundable once accessed or downloaded, except where required by law.
Customers are responsible for confirming that their devices and software can open the file formats described in the product listing. If a file is defective or inaccessible, please contact Ocean Devotion for assistance.
Promotions and Discount Codes
Promotions and discount codes may have individual eligibility requirements, expiration dates, and exclusions. Unless expressly stated otherwise:
Discounts cannot be combined
Discounts do not apply retroactively
Discounts have no cash value
Shipping and taxes are excluded
Ocean Devotion may end or modify a promotion at any time
